Official Rules

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

Eligibility: REALTRUCK located at 4414 SW COLLEGE RD SUITE 1410 (“Sponsor”) is sponsoring a CARLISLE ALL TRUCK NATIONALS giveaway promotion from AUGUST 5, 2022 through AUGUST 7, 2022 at 11:59:59 p.m. ET (“Sweepstakes Period”) called the “Follow RealTruck and Win a RealTruck Giftcard” (the “Sweepstakes”).  Participants must be a legal resident of the fifty (50) United States or Washington, D.C., be 18 years of age or older, who are in attendance at the Carlisle All Truck Nationals (the “Event”) scheduled to take place during the Sweepstakes Period at the Carlisle Fairgrounds in Carlisle, PA and agree to these Official Rules. Void where prohibited. Eligibility requires satisfactory proof of eligibility before awarding the prize. Employees of Sponsor, its advertising and promotion agencies, and suppliers and their Immediate Family Members, and/or Household Members of each, are not eligible to participate in the Sweepstakes. In the event the entrant is determined not to be eligible, another name will be selected from all of the eligible entries. Limit of one (1) entry per household. “Immediate Family Members” shall mean parents, stepparents, children, stepchildren, siblings, stepsiblings, or spouses.  “Household Members” shall mean people who share the same residence at least three (3) months a year. 

Agreement to Rules: By participating, you agree to be fully and unconditionally bound by these Official Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Sponsor as final and binding.

How to Enter: To enter the Sweepstakes, you'll first need to become a registered user of www.Instagram.com (“Instagram”) or log into your Instagram account.  If you do not have an account, go to www.Instagram.com to create one. Instagram accounts are free. By submitting your information and creating an Instagram account, you agree to the Instagram Terms of Use and Privacy Notice. If you do not agree to such Terms of Use and Privacy Notice, you cannot create an Instagram account, or participate in this Sweepstakes.  Additionally, to enter, your account must be set to public.

Entrants must first visit Sponsor’s booth at the Event and sign-up to receive emails from Sponsor to get a RealTruck hat or T-shirt.  Then follow @RealTruck on Instagram, take a picture in front of a truck (their own or a truck at the All Truck Nationals show) wearing your RealTruck T-shirt or hat (the “Photo”), along with #Sweepstakes (the “Required Hashtag”) and  tagging @RealTruck (the “Tag”). The Photo, Required Hashtag and the Tag shall collectively be known herein as the “Social Post”. .

Entries that are not complete or do not adhere to the rules and specifications may be disqualified at the sole discretion of the Sponsor. Multiple entries not allowed. Entries which use fraudulent methods to otherwise circumvent the rules such as using multiple addresses or identities will be removed from eligibility at the sole discretion of the Sponsor.

Each Social Post entry must meet the following “Entry Requirements” (any entry that, in Sponsor’s sole and absolute discretion, violates the following criteria will be disqualified):

•  Entry must be posted to a non-private social media account;

• Entry must NOT contain any material that infringes or violates any right of a third party including copyright, patent, trademark, trade secret or other proprietary rights (except those belonging to Sponsor);

• Entry must NOT include third parties/people, who have not expressly authorized in writing the entrant to feature their name, image, likeness or voice in the entry or otherwise use such name, image, or likeness in accordance with these Official Rules (if applicable, any selected winner may be required to verify such authorization in the form of a release); 

• Entry must NOT contain subject matter which is, or could be considered, in the sole discretion of the Sponsor, obscene, pornographic, violent (e.g., relating to murder, the sales of weapons, cruelty, abuse, etc.), defamatory, libelous, discriminatory (based on race, sex, religion, natural origin, physical disability, sexual orientation or age), illegal (e.g., illegal gambling, underage drinking, substance abuse, computer hacking, etc.), offensive, threatening, profane, hateful, degrading, harassing, or otherwise unlawful, tortious or objectionable;

• Entry must NOT contain any content that promotes any particular political agenda or message;

• Entry must NOT communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate;

• Entry must NOT violate any law;

• Entry must NOT contain any derogatory references to Sponsor

By posting a Social Post, entrants affirm that they have read, understand and agree to these Official Rules.  Entrants understand that they are posting their entry at their sole risk.  Sponsor is not responsible for any claims arising from the entries, specifically including, but not limited to, claims for intellectual property infringement and privacy rights violations, as well as violations of the respective social media platform’s terms and conditions. 

Proof of entry is not considered proof of delivery to or receipt of such entry.  Furthermore, Sponsor shall have no liability for any entry that is lost, intercepted or not received by the Sponsor.

In the event of a dispute regarding the identity of the individual who actually submitted an entry and/or review cannot be resolved to Sponsor’s satisfaction, the affected entry and/or review will be deemed ineligible.  Sponsor shall not be responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error, which may occur in the processing of the entries in the Sweepstakes.  Sponsor assumes no responsibility or liability for any error, omission, interruption, deletion, theft or destruction, or unauthorized access to, or alteration of entries and/or reviews.  Incomplete entries and/or reviews will be disqualified.

Drawing and Notification: At the end of the Sweepstakes Period, Sponsor shall randomly select one (1) potential winner from all eligible entries received during the Sweepstakes Period. Winner(s) will be contacted by DIRECT MESSAGE ON INSTAGRAM and/or a comment on their Social Post with instructions on how to verify eligibility claim the winner’s prize.  Prize winner shall be solely responsible for all federal, state and/or local taxes, and the reporting consequences thereof, and for any other fees or costs associated with the applicable prize.  Any potential prize winner must execute and return an Affidavit of Eligibility, a Liability Release, and (where imposing such condition is legal) a Publicity Release (collectively, “Prize Claim Documents”).  If winner fails or refuses to sign and return all Prize Claim Documents within seven (7) days of prize notification (or a shorter time if required by exigencies), winner may be disqualified and an alternate winner may be selected. Sponsor shall have no liability for a winner's failure to receive notices for any reason, including but not limited to failure of electronic infrastructure, misdirection into winners' spam/junk e-mail file,  winner’s security settings, or for winners' provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within three (3) business days from the time the award notification was sent, or fails to return completed and executed Prize Claim Documents as required, the prize may be forfeited and an alternate winner selected. Sponsor, in its sole discretion, will attempt to contact up to three (3) potential winners of a prize in accordance with the above procedure, after which the prize in question may go unawarded if it remains unclaimed.  If any potential prize winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines the prize for any reason prior to award, such potential prize winner will be disqualified and an alternate prize winner may be selected. The receipt by winner of the prize offered in this Sweepstakes is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

Prizes: One (1) Prize is available.  The Prize consists of two (2) $500 GIFT CARDS for realtruck.com.  Gift card is subject to separate terms and conditions imposed by issuer.  The prize is nontransferable. Any and all prize related expenses, including, without limitation, any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. The prize winner will be issued a 1099 tax form for the actual value of the Prize received and will be required to fill out a W-9 form prior to receiving the Prize.  No substitution of a prize or transfer/assignment of the prize to others or request for the cash equivalent by winners is permitted. Limit one (1) prize per household.

Odds: The odds of winning depend on the number of eligible entries received.

Rights Granted by you: By entering the Sweepstakes you understand that Sponsor, anyone acting on behalf of Sponsor, or its respective licensees, successors and assigns will have the right, where permitted by law, without any compensation or remuneration of any kind or further notice, review or consent to use any e-mail provided by you for marketing purposes, to print, to publish, broadcast, distribute, and use, worldwide in any media now known or hereafter developed in perpetuity and throughout the world, your Social Post, including, without limitation, the your name, portrait, submitted images, voice, likeness, image or statements about the Sweepstakes, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.

Terms: Sponsor reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Sweepstakes should, in Sponsor’s sole discretion, a fraud or other causes beyond its control corrupt or affect the administration, fairness or proper conduct of the Sweepstakes. In such case, Sponsor may select the Prize winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or violates these Official Rules. Sponsor has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void entries for any reason, including, but not limited to: multiple entries, or the use of bots, macros, or scripts or other technical means for entering. Any attempt by an entrant to deliberately damage or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.

Limitation of Liability: By entering you agree to release and hold harmless Sponsor, and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) your participation in the Sweepstakes and/or your acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Sweepstakes; and/or (v) electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries.

Disputes: THE SWEEPSTAKES IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF FLORIDA, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN OCALA, FLORDIA. The remedy for any claim shall be limited to actual damages, and in no event shall any party be entitled to recover punitive, exemplary, consequential, or incidental damages, including attorneys’ fees or other such related costs of bringing a claim, or to rescind this agreement or seek injunctive or any other equitable relief. Except where prohibited, you agree that any and all disputes, claims and/or causes of action arising out of, or connected with the promotion or any prize award shall be resolved individually, without resort to any form of class action. 

Winners List: The name of the Prize winner will be available by visiting REALTRUCK.COM on about AUGUST 20, 2022. The winners list will be available for at least thirty (30) days.
